Under Federal Rule of Civil Procedure 4(m), the Plaintiff must serve the defendant with the complaint within 90 days. Otherwise, the court, on motion or with notice to the plaintiff, must dismiss the action without prejudice. However, if the plaintiff shows good cause, then the court will grant an extension of time to serve the complaint on the defendant.
